Outside our office, I’m passionate about our local community, including 10 years serving as an attorney advisor for New York’s statewide high school mock trial tournament, as well as Commissioner of WNY’s 16-team Lawyers’ Softball League. This is Migir Ilganayev, dictating a quick message about a lawsuit filed by Diesel Funding LLC against Enzo’s LLC and Sara Anne Oglesby. The case was filed in Warren County Supreme Court on February 13, 2026.
Diesel Funding LLC entered into a contract dated December 3, 2025, and ENZO’S LLC sold its future receipts to Diesel Funding LLC with a total value of $67,455.00 (receivables) for the purchase price of $45,000.00. However, ENZO’S LLC did not deliver the receivables and defaulted under the contract on February 6, 2026, after stopping payment on an ACH remittance. Because Sara Anne Oglesby personally guaranteed this contract and now seeks approximately 50,691.25, plus interest and attorney fees.
If no response or appearance is filed within the court’s deadlines, a default judgment could be entered, potentially leading to frozen accounts or seizure of assets. My firm has handled many cases involving sales-based financing disputes like this, sometimes we’re able to negotiate reduced amounts or challenge claims successfully.
