New York MCA Defense Lawyer

Defending a Hawaii Business in a New York MCA Lawsuit

A Hawaii business sued on a merchant cash advance will be defending in New York, where the court day ends before the working day begins at home. The deadlines are New York deadlines, but most of the early work is written, which is the part the time difference does not touch.

The court closes before you open

A Honolulu business sued in New York is operating six hours behind its own case. When the clerk's office opens at nine in Manhattan it is three in the morning at home. When a filing deadline expires at the end of the New York business day, it is early afternoon in the islands and the day still feels unfinished.

Nothing about that changes the law. It changes the way the work has to be organised, and organising it badly is the only way the time difference actually hurts.

Treat every date as a day earlier

This is the entire practical answer and it is worth stating plainly. A deadline in a New York case is a New York date. If something is due on the twentieth, it is due at the close of the twentieth in New York, not when the twentieth ends in Hawaii.

Working to the day before costs nothing, absorbs the gap, and removes the one failure mode the geography creates: a document prepared on time, in local terms, and filed late in the terms that count.

The deadline itself

CPLR § 320 requires a defendant to appear within twenty days after service of the summons — by serving an answer, by serving a notice of appearance, or by making a motion that extends the time to answer — with longer periods in defined circumstances including particular methods of service.

Twenty days is not long anywhere. It is shorter when part of it is spent finding a lawyer admitted five thousand miles away, locating the original agreement, and getting readable copies of both to someone in another time zone. The useful response is to compress the front of that process rather than the back: send what you have on day one, incomplete, and fill the gaps while counsel is already reading.

What happens if the window closes

CPLR § 3215 is what follows a missed appearance. Where a defendant has failed to appear or plead, the plaintiff may seek a default judgment, and where the claim is for a sum certain the application may be made to the clerk within one year of the default, with judgment entered on the requisite proof.

A merchant cash advance balance is the kind of number that is presented as a sum certain. So the consequence of the time difference being mishandled is not a telling-off from a judge; it is a judgment produced administratively, which then has to be attacked rather than defended against.

Most of the early case is paper

The reassuring part, and it is genuinely reassuring: the opening months of one of these matters consist of filings. An appearance. An answer with defenses and any counterclaims. Demands for the funder's own records of what was debited and when. Written motions where the agreement supports them.

None of those require anyone to be in a room. The question of whether the case belongs in New York at all is argued the same way — on papers, by a lawyer admitted there, from documents sent by email.

And why it is in New York

Because the agreement said so. GOL § 5-1402 supports a forum clause where the parties chose New York law, the transaction covers at least $1,000,000, and the agreement contains a submission to New York jurisdiction. Plenty of advances fall short of that figure, in which case the clause is tested on ordinary grounds instead of resting on the statute.

That is an argument worth making from Hawaii as much as from anywhere, and possibly more.

What to do first, from Hawaii

  1. Convert the deadline to a local date, then subtract a day. Write that date down and work to it.
  2. Photograph or scan the summons and the agreement today. Partial is fine. Sending beats collating.
  3. Ask any prospective lawyer about New York admission before anything else. Distance makes this the fastest way to rule people out.
  4. Note how and when you were served. It sets the real date, and it is sometimes the defense.

How an MCA lawsuit is defended describes the course of the case. A restrained account and a confession of judgment cover enforcement that has already begun.

How it works

How your case moves

This is the shape of a defended merchant cash advance lawsuit. A judgment already entered, or an account already frozen, runs on its own track alongside it.

FAQ

Questions people ask at this stage

How does the time difference affect my deadline?

It does not extend it. A New York filing deadline is a New York date, so a document due on a Friday is due on a Friday there, which has already ended while it is still afternoon in Honolulu. That is a scheduling fact rather than a legal one.

The practical answer is to treat every deadline as falling a day earlier than it reads. It costs nothing and removes the only genuine risk the time zone creates.

Will I have to fly to New York?

Usually not in the early stages. The first phase of one of these cases is documents: an appearance, an answer, demands for the funder records, and written motions. Those are filed rather than attended, which is the part geography does not reach.

How quickly do I need to act?

New York gives a defendant twenty days after service of the summons to appear, with longer periods in defined circumstances including particular methods of service. Finding counsel and getting documents across the Pacific has to fit inside that window, so the first day matters.

Why is the case in New York in the first place?

The agreement chose it, and these agreements almost always do, whatever state the business trades in. Whether the clause binds a particular defendant is a question about the document, and the statutes behind such clauses carry dollar thresholds many advances never reach.
