Kentucky Guarantors and What an MCA Judgment Can Reach
When a merchant cash advance judgment names a Kentucky owner personally, the creditor gains tools aimed at a person rather than a business. One of them is the income execution, which works on earnings over time and follows a different path from a bank account restraint.

Once the judgment names a person, the toolkit changes
A merchant cash advance judgment usually names two debtors: the company and the owner who guaranteed the deal. Those are not two versions of the same exposure. A company has receivables, equipment and a bank account. A person has wages, draws, distributions and a home.
Creditors notice the difference, and they choose instruments accordingly. The one aimed squarely at a person is the income execution.
What an income execution is
CPLR § 5231 sets out its form. An income execution must specify the name and address of the person or entity from whom the judgment debtor is receiving or will receive money, the amount of that money, how often it is paid, and the installments to be collected from it. It must also contain a notice to the judgment debtor to commence paying those installments to the sheriff.
And then the key structural detail: upon the debtor's default on that demand, the execution is served upon the person or entity from whom the debtor receives the money.
So it runs in two stages. First a demand on the debtor. Then, if that is ignored, the instrument goes to whoever is paying them.
Which is not how a frozen account works
The two enforcement routes get conflated constantly, and they behave quite differently.
A restraining notice under CPLR § 5222 may be issued by the clerk or by the judgment creditor's attorney as an officer of the court and served on any person holding property in which the debtor has an interest. It arrives without a preliminary demand, it goes straight to the holder — usually a bank — and it acts on what is already there.
An income execution acts on what is coming. It involves the debtor first. It operates in installments over time rather than as a single hold.
The practical consequence: an owner can experience both, in either order, from the same judgment, and the right response is not the same for each.
How much can be taken
This page does not say, and that is deliberate. The limits on an income execution, and how they interact with federal restrictions, were not researched for this draft, and a figure stated confidently and wrongly on a law firm page is worse than an acknowledged gap.
What can be said is that an income execution is capped rather than open-ended, that the cap is a question for counsel on the specific facts, and that the answer depends on who is paying the debtor and in what form — employment, draws from the business, or distributions are not identical situations.
Why there is a judgment at all
Either the case was defended and lost, or nobody appeared. CPLR § 320 sets the appearance window at twenty days after service of the summons, with longer periods in defined circumstances including particular methods of service, and a guarantor's window runs separately from the company's.
A great many of these judgments exist because the company engaged and the person did not, on the assumption that one response covered both. It does not.
And why New York
The agreement chose it. What a New York judgment can then do to earnings or accounts located in Kentucky runs through Kentucky procedure, and that part needs counsel admitted there. Whether the New York judgment should stand is the New York question, and it is the one that makes the rest unnecessary if it succeeds.
What to do first, from Kentucky
- Find out whether the judgment names you, the company, or both. It determines which instruments are available.
- Get the index number and county, and obtain the judgment and the affidavit of service.
- Establish how you are paid. Salary, draw and distribution are different facts for this purpose.
- Do not ignore a demand addressed to you personally. The second stage of an income execution is triggered by default on the first.
A restrained account covers the bank route, a confession of judgment covers judgments entered without a lawsuit, and how an MCA lawsuit is defended covers the case itself.

How it works
How your case moves
This is the shape of a defended merchant cash advance lawsuit. A judgment already entered, or an account already frozen, runs on its own track alongside it.

FAQ
Questions people ask at this stage
What is an income execution?
An enforcement instrument aimed at money a person receives. New York requires it to specify who is paying the debtor, the amount and frequency of that money, and the installments to be collected, with notice to the debtor to begin paying the sheriff.
The structure matters: it starts as a demand on the debtor to pay installments, and the execution is served on the payer upon default of that demand. It is a sequence rather than a single event.
How is that different from my account being frozen?
A restraining notice is served on whoever holds your property, typically a bank, and it holds funds already there. An income execution is directed at money coming in over time. One is a snapshot of a balance; the other is a claim on a stream.
Does it reach the business or me?
This instrument is aimed at a person receiving money, which in these cases means the owner who signed the guaranty rather than the business. The company and the guarantor are separate judgment debtors with separate exposure, and a creditor will pursue whichever of them looks more collectable.
Can anything be done once a judgment exists?
Sometimes, and it depends on how the judgment came about. If it was entered without an appearance, or on a confession signed at the outset, the route to challenge it differs from the route after a defended case. The court file is where that is established.
Why is a New York judgment reaching me in Kentucky?
Because the advance agreement chose New York, so the judgment was obtained there. What a New York judgment can do to assets and earnings outside New York runs through the procedures of the state involved, which is a question for counsel admitted there.
